A federal high court in Abuja has fixed January 13 to hear a N300 million lawsuit filed by Speed Darlington against Kayode Egbetokun, the inspector-general of police.

Darlington was arrested on November 27 while performing at a show in Owerri, Imo state. He was accused of cyberstalking Burna Boy, the Grammy-winning artiste.

His lawyers Adeyanju and Stan Alieke have described his continued detention as “unjustifiable”.

On December 23, Alieke announced on Instagram that the court had granted Darlington bail.

Adeyanju also posted on X that the court ordered Darlington’s arraignment within 48 hours or his release on bail.

However, Alieke later revealed that Darlington was never arraigned while Adeyanju accused the police of refusing to release the singer despite the court order.

According to NAN, Musa Liman, the judge, fixed the date after Abubakar Marshal, the singer’s counsel, sought an adjournment to enable Garba Audu, the IGP’s lawyer, to study and respond accordingly to the processes served on him in the open court.

Upon resumption of the court hearing on Monday, Marshal informed the judge that the case was set for the hearing of the originating motion on notice regarding the enforcement of Darlington’s fundamental rights.

Though Audu said he has yet to be served with the process, the court confirmed through the proof of service in its record that the police were duly served.

Darlington sued Egbetokun as a sole respondent and urged the court to declare that his arrest and detention violated his fundamental rights as guaranteed by the 1999 constitution.
In the suit filed by Adeyanju, he sought an order directing the IGP to immediately and unconditionally release him from the detention facility where he is being kept.
He also requested an order mandating Egbetokun to produce him before the court to enable inquiries into the circumstances constituting grounds of his arrest, and detention and where it deems fit, admit him to bail.
The suit also sought “an order directing the respondent to pay the applicant the sum of N300,000,000.00 only as general, exemplary and aggravating damages for their unlawful and continued detention since the 2024 till date”.
