Melaye found himself on the brink of a recall after a register containing signatures of more than half of the voting population in Kogi west senatorial district where he represents was submitted to the Independent National Electoral Commission (INEC).
INEC had released a timetable for his recall and had to halt the process when a federal high court ruling held that INEC and Melaye should maintain “status quo” pending the determination of a suit filed by the senator to challenge the process.
INEC has since appealed the court ruling on grounds that the order was against its time-bound constitutional duty, which is the 90-day time frame stipulated by law to carry out a recall.
